29. OVERTIME PAYMENTS

General

  1. Wherever possible, the University will minimise the use of working arrangements which involve the attendace of employees at their place of work outside the employee's usual working hours. However, where such working arrangements are unavoidable the employee shall be entitled to the appropriate allowances (should lieu time/compensatory leave of absence not be granted). These allowances are as follows:-

  2. Overtime Working

Overtime is payable only to employees in receipt of basic salary of scp 28 or less on the following basis:-

(i) The basic salary shall be divided by 37 to ascertain the hourly rate of overtime.

(ii) Extra time of less than half an hour on any day shall not rank for overtime. Overtime shall be aggregated for each calendar month and only complete half hours paid for.

(iii) Officers for whom it is a condition in their contract of employment that they shall work hours longer than the standard 37 shall be entitled to overtime payments unless the additional hours are recognised by some other payments or arrangements that were determined by the University of Sunderland.

(iv) For overtime on any day other than a Sunday or a general public holiday, payment shall be at time and a half. For overtime on a Sunday, payment shall be at double time

c. Normal Working Weeks

Where the working arrangements is part of the normal working week and is required by the University, then:-

(i) Weekend Working

For work on a Saturday or Sunday as part of the normal working week payment shall be at time and a half for all hours worked.

(ii) The weekend work enhancement shall be payable, where appropriate, in addition to the enhanced rate of pay for night work worked as part of the normal week.

(iii) Work on a Saturday or Sunday outside the normal working week shall be regarded as overtime and paid for in accordance with (b).

d. General and Public Holiday working: Extra Statutory Working Holiday

(i) For work on a general or public holiday, in addition to the normal pay for that day, payment shall be at plain time for all time worked within an employees normal working hours. At a later date time off with pay shall be allowed as follows:-

When the time worked is less than four hours - half day off
When the time worked is four hours or more - full day off Work on that day outside normal working hours shall be paid for, as overtime, at double time in complete recompense.

e. Night Work

i. For work at night as part of the normal working week payment shall be at time and a third for all hours worked between 8.00 p.m. and 6.00 a.m.

ii. The premium rate for night work is not payable to officers when working irregular hours or employed on shift work.

iii. The night work rate shall be payable, where appropriate, in addition to the enhanced rate of pay for work as part of the normal working week on Saturday and on Sunday.

iv. Work at night outside the normal working week shall be regarded as overtime and paid for in accordance with the relevant sections of this paragraph.

f. Shift Allowances

i. Alternating Shifts - An alternating shift allowance shall be payable where:-

- the total period covered by the shifts is 11 hours or more;

- there are at least four hours between the starting time of the earliest and latest shifts;

- the number of "normal office hours" shifts does not exceed one half (i.e. 1 in 2) of the total number of shifts in the rota.

Where the conditions of paragraph 28f (i) are satisfied, the following allowances are payable where two shifts on a rota basis not including a night shift are worked over 4, 5 or 6 days a week:-

- Where the total period covered by ...... 12½% of salary the two shifts is between 11 & 14 hours.

- Where the total period covered by ....... 14% of salary two shifts is more than 14 hours

ii. Rotating Shifts

A rotating shift allowance shall be payable where:-

- the total period covered by the shift is 18 hours or more;

- at least four hours are worked between 8.00 p.m. and 6.00 a.m.

Where the conditions of paragraph 28 f(ii) are met, the following allowances will apply:-

- Three shifts on a rota basis including a ..... 17% night shift over 5 or 6 days a week of salary

- Three shifts on a rota basis including a ...... 20% of night shift over 7 days a week salary

The shift enhancement shall be payable, where appropriate, in addition to the enhanced rate of pay for work on a Saturday or Sunday as part of the normal working week.

Time worked beyond the normal shift shall be regarded as overtime and paid for in accordance with section b of paragraph 28.

g. Irregular Hours Working

i. An irregular hours working allowance shall be payable where as part of the normal working week an Employees hours of duty during Monday to Friday fall outside the period one and a half hours before and/or one and half hours after the University's normal office hours.

ii. The allowance shall be as follows:

- For an average of four hours, but less than eight hours per week beyond the qualifying period calculated over the working cycle ...... 7½% of salary.

- For an average of eight hours or more per week beyond the qualifying period, calculated over the working cycle ..... 10% of salary

iii. The premium rate for irregular hours working is not payable to officers when working at night or employed on shift work.

iv. Part-time employee: no payment shall be made to employees employed on a part-time basis

h. STANDBY ALLOWANCES

In the case of employees who are not graded above APT & C SO2 and who are required to by the University to undertake standby duty by specific rota commitment in order to be immediately available, if needed, and this fact is not reflected in the salary grading applied to the post, the University shall have discretion to pay locally agreed allowances which reflect the circumstances of that duty.

Standby Duty on a Bank or Public Holiday

Employees who are required to undertake and respond to a standby duty in accordance with paragraph (h) above on a bank or public holiday shall in addition be granted compensatory leave of absence at a later time to be agreed with the Head of Service/Director of School.
